The Terms and Conditions of PROSUS Climbs & Safaris

  • When the Terms and Conditions apply

    These Terms and Conditions govern the relationship between the Client (you) and PROSUS Climbs & Safaris (we) and apply, when you book a trip with us.

  • Your Personal Information

    We shall require certain personal information to take care of your expedition arrangements. Such information includes your full name, age, nationality, passport information, diet, and medical particulars.

    Parts of this information will be made available to the administration of the Mount Kilimanjaro National Park, Arusha National Park, and the Tanzania wildlife areas for the processing of entry permits as well as to the accommodation providers.

  • Our Warranties

    We warrant that:

    • We have all the necessary licenses and permits to organize and run Kilimanjaro and Mount Meru climbing expeditions and wildlife safaris in the United Republic of Tanzania.
    • All our Kilimanjaro and Mount Meru guides, wildlife safari driver-guides and consultants have professional training in their respective fields.
    • All information that we use in marketing and advertising is true and correct. We do not exaggerate or misrepresent anything in the description of our products.
  • Booking and Payment

    To secure your booking we require a deposit of 10%.
    You can change your tour to a different date without any cost. We will hold your booking until you can decide on a new date.
    Your deposit is a lifetime deposit which means that it can be transferred to another trip at any point and lasts for life. This means that if you book your tour and have to cancel for any reason, your deposit can be held until you want to re-book onto another trip.

  • Prices

    Once we confirm your booking, the price will not be changed, except for the unlikely case of the government of Tanzania increasing park fees, taxes or other tourism-related payments. In such a case, a copy of the relevant public notice shall be made available to you immediately. Two options shall be available to you in case of price increase:

    • To cancel your tour and receive a refund in accordance with our cancellation policies
    • To agree to the change of price and pay the difference to us
  • Cancellation and Refunds

    Cancellations by you

    If you decide to cancel your travel arrangements with us, the following cancellation fees will apply:

    • 100 % refund of the total cost if you cancel at least 90 days before the departure date
    • 90 % refund of the total cost if you cancel at least 60 days before the departure date
    • 50 % refund of the total cost if you cancel at least 30 days before the departure date
    • No refund if the booking is cancelled less than 7 days before departure date

    In all cases of cancellations you will also need to cover our non-refundable and/or partially refundable expenses, such as hotel reservations or domestic air tickets. Before issuing a refund, we will deduct those expenses and the costs of fund transfer (banking commissions and credit card surcharges) from the payments that you made to us.

     

    Cancellations made by PROSUS Climbs & Safaris

    In the unlikely event of us cancelling your tour for any reason, a 100% refund of any payments already made by you to us will follow.

  • Health and Fitness Requirements

    Participating in a mountain trek involves physical exertion and potential risks. By booking and participating in a tour, you acknowledge and confirm that your are in good health and posses the necessary physical fitness to undertake the tour.

    You understand that mountain climbing can be strenuous and demanding, requiring endurance, strenght, agility, and acclimatization to high altitudes. It is your responsibility to ensure that you are adequately prepared physically and mentally for the challenges posed by the tour.

    You should disclose any pre-exisiting medical conditions, disabilities, or allergies that may affect your ability to undertake the tour.

    You agree to provide accurate and complete medical information to us and follow any guidelines or recommendations provided by us or our guides regarding health and safety during the tour.

    If, during a tour, you are deemed unfit to continue due to health reasons, we reserve the right to exclude you from further further participation in the tour. In such cases, you will not be entitled to any refund or compensation.

    You acknowledge that you are responsible for your own medication, including any prescription drugs or necessary medical supplies, and for informing the tour operator of any specific medical needs or dietary requirements.

    We are not liable for any illness, injury, or adverse health effects that may occur during or as a result of a tour, except where such illness, injury, or adverse health effects are directly caused by our negligence.

    By booking and participating in a tour, you assume all risks associated wiht your health and fitness and agrees to release and hold us harmless from any claims, damages, or liabilities arising from any health-related issues or conditions.

  • Itinerary and Changes

    Changes by you
    Any changes you make to your itinerary will be made free of charge if they do not result in extra costs for us. Any such costs must be covered by you.
    If you decide to discontinue our tour after it stated, either voluntarily or involuntarily, you will be liable to cover any extra costs caused by your decision to leave the trip. Such costs may include but are not limited to covering transportation and accommodation expenses.
    If you miss any tour service, sightseeing or meal, or fail to use any other service acting on your own account, no refund will be provided.


    Changes by PROSUS Climbs & Safaris
    While we do our best to ensure that your tour goes as planned, situations may arise (e.g. parts of the planned route becoming inaccessible due to poor weather conditions) requiring us to change your itinerary. Though rare, such cases are not to be ruled out and we will endeavour to inform you of them promptly.


    Changes by third parties
    We are not be liable for any delay, disruption, damage or loss outside of our reasonable control. These may include – but are not limited to – third-party actions, flight delays and any events of a force majeure nature.
    You or your insurance company will be liable to cover any expenses, such as extra accommodation and transportation expenses, caused by such change or disruption.

  • Travel Insurance

    You are required to have comprehensive travel insurance that covers your activities.

    You are responsible for ensuring that your insurance policy meets the requirements and provides adequate coverage for the activities involved. We reserve the right to request proof of insurance prior to the commencement of your activity with us.

    We are not responsible for any costs or liabilities incurred by you due to inadequate or insufficient  insurance coverage.

  • Force Majeure

    We are not liable or responsible for any failure to perform our obligations under these terms and conditions if such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government regulations, strikes, labor disputes, transportations disruptions, or any other force majeure event.

    In the event of a force majeure event, we reserve the right to modify, postpone, or cancel tours without liability. If tours are cancelled due to a force majeure event, we will make reasonable efforts to provide alternative options or reschedule the tours at a later date. However, we shall not be held responsible for any additional costs or expenses incurred by the particitpant as a result of such changes.

    The participant understands and agrees that we will not be liable for any losses, damages, injuries, or claims arising from force majeure events that affect the tours or their itineraries.

    We shall promptly notify the participant of any force majeure event and make reasonable  efforts to mitigate its impact. However, we cannot guarantee the availability of alternative arrangements or the feasibility fo rescheduling in all cases.

    By participating in tours, the participant acknowledges and accepts the risks associated with force majeure events and agrees to hold us harmless from any claims, damages, or liabilities arising from such events beyond our control.

  • Disputes

    The laws of the United Republic of Tanzania will apply in case of any disputes.
